Terms of Service

Last updated August 28, 2026

The service

BrandMyStream is software. A streamer can list overlay spots, send a brand to their own payment link, review a file, and (if they accept it) show that file in an OBS browser source while they are live.

We are not a party to the deal between a streamer and a brand. We do not sell the spot, collect the brand’s money, escrow it, or refund it. We do not guarantee a result: not that the streamer goes live, not that the overlay is loaded, not that a logo appears, and not that anyone sees it.

How we handle personal data is in the Privacy Policy.

Accounts

Streamer accounts use email and password. You must be at least 18, able to contract, and allowed to stream on Twitch under Twitch’s terms. You are responsible for the account and for what you publish on your public page and overlay. You decide which logos go on stream. That includes checking whether they are legal to show.

Keep your payment link accurate. Brands cannot buy until you add a payout link. Confirming “Payment received” means you actually received the funds.

Brand payments

What a brand pays for a spot goes to the streamer, on the streamer’s PayPal or payment link. BrandMyStream never receives, holds, or forwards that money. Stripe on this site is only for the streamer’s Pro subscription.

We do not verify that a transfer actually arrived. “Payment received” is the streamer’s click, not a confirmation from us. If a brand pays and the streamer never confirms, pays the wrong person, wants a refund, or disputes the amount — that is between the brand and the streamer. We do not mediate, charge back, or reimburse brand payments.

Logos, approval, and legality

A brand must have the rights to the logo and claims they upload. They must not submit illegal content, malware, impersonation, or material the streamer or we reasonably refuse (hate, porn, scams, or anything that would break Twitch rules).

BrandMyStream does not review uploads for legality, trademark, advertising rules, or Twitch compliance. We host a file the streamer chooses to put on their stream. Whether that image may be shown is the streamer’s problem to check and to accept or refuse.

On Free, the streamer must Approve before a logo can go live. On Pro they may turn on auto-approve; that is still their choice and their risk. Approving a creative — or leaving auto-approve on — means the streamer is solely responsible for displaying it, including if it is illegal, infringing, or against Twitch’s terms.

What we do not guarantee

Purchased time counts only while the streamer is live and the overlay is loaded. If they go offline, remaining time pauses. Reservations that nobody confirms expire so the spot can be sold again.

We do not guarantee that a logo will appear, stay on screen, or look as uploaded. Display depends on the streamer’s OBS setup, the browser source, Twitch, the network, and the file. We do not guarantee viewers, watch time, clicks, sales, or any other result. A paid spot is not a media buy we fulfill.

Plans and Pro

The free plan and Pro limits are described on the Pricing page. Free keeps a small BrandMyStream mark on the overlay. Pro removes it and raises the spot and monthly sales caps.

Pro is a recurring subscription billed by Stripe in euros, at the price shown at checkout (monthly, founding monthly where still offered, or yearly). It renews until you cancel. Cancel anytime; you keep Pro until the end of the paid period, then the account returns to Free.

If you are a consumer in the EEA or UK, you may have a 14-day withdrawal right for Pro. Checkout gives immediate access to the software. If you use Pro during that window, you may lose that right for the period already consumed. For a refund request, write to nico@pourquoi.app promptly and include the account email.

Our role and liability

We provide the software “as is.” We are not liable for missed airtime, a logo that does not show, a creative a streamer approved, unpaid or disputed brand invoices, or any other fight between a streamer and a brand. Those stay between you.

To the extent allowed by law, BrandMyStream’s total liability for a claim is limited to the Pro fees you paid us in the three months before the claim (or €50 if you are on Free). We do not exclude liability that the law does not let us exclude (for example, fraud or death caused by negligence).

Intellectual property

BrandMyStream and the product design stay ours. You keep your channel name, brand, and logos. You grant us a license to host and display them so the public page and overlay can work. That license is not a legal review and does not mean we endorse the creative. Brands grant the streamer and us the same limited license for the purchased placement.

Suspension

We may refuse, hide, or remove content, or suspend an account, if these terms, Twitch rules, or the law are broken, or if the service is abused (fake payment confirms, malware in uploads, spam). Doing that is optional and does not mean we review every file or take responsibility for what a streamer puts on air. You can close an account by emailing nico@pourquoi.app.

Law

These terms are governed by French law. If you are a consumer, you also keep any mandatory protections of your country of residence. Courts in France have jurisdiction, without limiting a consumer’s right to sue in their home courts where the law says so.

We may update these terms. The date at the top will change. Material updates may be emailed to streamers. Continued use after an update means you accept the new terms.
